3. Customer Obligations

You declare that you are at least 18 years old on the day of placing the order and that you are placing the order for personal purposes, unless otherwise agreed with Amanvida. If you are a B2B customer with an approved reseller account, you may place an order for professional purposes. You guarantee that all the information provided by you is correct, accurate, and up-to-date. You are the owner of the used bank card and/or PayPal account or have the permission of the owner. Your username and password for accessing your account are confidential. Do not share them with third parties.

4. Offer and Prices

The products on our website serve as an online catalog and do not constitute a binding contract. All products are described in good faith and as accurately as possible. Offers and prices are indicated in euros and are only valid on the order date. They can be changed at any time without notice. Only the price indicated on the website is valid between the parties. The total price at the end of the order process includes all taxes and shipping costs, except for export outside the EU (which is the customer's responsibility). For B2B customers outside Belgium, it is their responsibility to pay the relevant VAT and/or import duties, if applicable.

5. Ordering and Contract Conclusion

5.1 Order Process

  1. Select the desired products on the product page and add them to your cart.
  2. Go through the checkout process and accept the Terms and Conditions.
  3. Add your billing and delivery address.
  4. Choose your DPD shipping options.
  5. Complete the order through our secure payment platform MultiSafePay.
  6. You can create an account before or after your order.
  7. After receipt of payment, you will receive a copy of the invoice and a confirmation email.
  8. When your order is shipped, you will receive the DPD track & trace details by email.

5.2 Confirmation and Cancellation

We reserve the right not to validate an order in case of:

  • Unavailability of products
  • Payment refusal by your bank or suspicion of fraud
  • Large quantities of the same product or the same delivery address
  • Abuse of the right of withdrawal

In such cases, any amounts paid will be refunded and the order will be canceled.

5.3 Confirmation Email and Contract Conclusion

The contract is concluded as soon as you receive a confirmation email. Check your inbox and spam folder for this email.

5.4 Electronic Invoice

You agree to receive an electronic invoice.

6. Payment

The proposed payment methods are:

In case of incorrect bank details, chargeback, or insufficient funds, for which you or a related third party are responsible, any resulting costs and bank fees will be at your expense.

Orders are always paid in advance by the customer unless explicitly agreed otherwise. In this case, payment of the purchase price is due at the conclusion of the contract. To the extent that the legal requirements are met, the customer is automatically considered to be in default if he does not make the payment within 30 days from the date on which this payment becomes due and the invoice, in which the consequences of late payment are specifically mentioned, has been received. In case of late payment, you are obliged to pay default interest of 5% per year. No reminder letter or notice of default is sent. The debtor is not considered to be in default if the delay is due to a reason beyond his control.

7. Order Proof

Automated registers stored in our systems can serve as proof for communications, orders, and payments between the parties.

8. Delivery

We deliver the products via DPD to the address you have provided. Packages can be delivered to your home, to a business, or to one of the thousands of DPD parcel shops. Delivery times are usually 2 to 7 working days, unless otherwise specified. Our deliveries are free from a certain order amount indicated on the website at the time of the order (after deducting purchase/discount vouchers and before applying shipping costs). For all other orders, shipping costs are charged in accordance with the information provided on the website at the time of the order. Any risk of loss or damage to the goods is transferred to you upon receipt of the goods, that is, when you, or a third party designated by you who is not the carrier, physically take possession of the goods.

Delivery Time: The delivery times indicated by us are always approximate and not binding, unless explicitly stated otherwise. No compensation is possible for delays in delivery or performance. In case of negligence by the buyer, the price may be adjusted to the price applicable at the time of delivery.

We also have the right in this case to claim compensation for all resulting costs and damages. If the buyer refuses to use our own transport, we may charge 50 euros in transport costs for the use of an external carrier. In case of free delivery, the goods travel at the buyer's risk. All goods we deliver are carefully checked at departure. In case of a manufacturing defect detected and accepted by us, we reserve the right to replace the disputed items.

If you provide an incorrect address, erroneous information, or omit essential information, causing the package to follow a non-standard route, additional costs may be charged. Essential information includes: Street + house number & apartment number, if applicable, postal code, city, country, phone number, and email address. If there are additional delivery instructions, it is the customer's responsibility to communicate them during the checkout procedure or via email to info@amanvida.eu. If mentioned via email, this must be done within one hour of placing the order.

The return of goods is only allowed after prior agreement and provided that we have given our written consent. No discount or deduction will be granted on the amount of our invoices if no credit note has been issued by us.

If the order is placed by phone, handwritten by fax, or by email, an administrative fee of 10 euros is charged. For orders via the website or via uploadable files (csv, excel, pdf, etc.), no administrative fees are charged.

9. Returns and Right of Withdrawal

You have the right to withdraw from the purchase within 14 days of receipt. Returns are at your own cost and risk, unless we, Amanvida - Mannavita BV, have made a mistake, such as in the case of an incorrect or defective item. In all other cases, return costs are charged. If you arrange your own transport, it must be traceable. We accept no responsibility for lost packages. Returned goods must be unopened, undamaged, and resalable.

After receipt of the goods that are undamaged and in good condition, the refund will be processed within 14 days of receipt.

10. Complaints and Disputes

Complaints must be submitted in writing to info@amanvida.eu. Complaints about visible defects must be made in writing within 48 hours of delivery. Customers can also contact us by phone for more information. Customers must provide photographic evidence or other proof of their complaint. You can always contact our customer service. In case of disputes, you can also contact the European online dispute resolution platform, available at https://ec.europa.eu/consumers/odr.

11. Liability Limitations

We cannot be held liable for non-performance or poor performance of the contract due to your fault, unforeseeable circumstances, or force majeure.

12. Legal Guarantees

Legal guarantees are applicable. We guarantee that our products comply with the agreement and legal regulations.

13. Retention of Title

The goods remain the property of the seller until full payment of the price. All risks are borne by the buyer. If the buyer fails to fulfill his obligations, the sale may be terminated by law and without notice, so that the seller is always entitled to retrieve the delivered goods from the buyer, without prejudice to the seller's right to compensation and interest. The seller's will to this effect by registered letter is sufficient for this purpose.

14. Final Provisions

14.1 Changes to the T&C

We can change these T&C at any time without notice. New T&C are posted online and are immediately applicable.

14.2 Severability

If any part of these T&C is declared invalid or null, the remainder remains in force.

14.3 Agreement on Proof

Electronic communication between the parties has the same probative value as written documents.

14.4 Force Majeure

Neither party is responsible for delays or non-performance of obligations due to force majeure.

14.5 Relationships

Our relationship with you is that of an independent contractor. In case of disputes between users, we do not mediate.

14.6 Communication and Notification

Communication is deemed valid if sent to your registered email address.
